Turfcare Australia’s Advantage Membership Club
- Introduction
- These terms and conditions apply to Turfcare Australia’s Advantage Membership Club (the Club), operated by Ace Ohlsson Pty Limited (ABN 24 003 471 010) (Ace).
- While your transacting account will be held with Ace, this Club applies exclusively to products sold under the trading name Turfcare Australia (the Business), which is a business operated by Ace.
- By registering for the Club, you agree to be bound by these Terms & Conditions, as updated from time to time. The Club provides exclusive offers, discounts, and rewards on products sold by the Business to eligible customers.
- Eligibility
- To qualify for Club membership and benefits, you must:
- Complete and submit the Club membership application form in the manner specified by Ace;
- Like and follow the Business’ Facebook page;
- Hold a valid 30-day account with Ace or apply for one online and have it approved; and
- Provide a valid email address for Club communications, which must be different from your accounts email address.
- Not operate primarily as a wholesale, distribution, or reseller business.
- Ace reserves the right to accept or reject any membership application at its discretion.
- Member Obligations
- By joining and participating in the Club, you agree to promptly provide any information or documentation reasonably requested by Ace to verify your compliance with these Terms & Conditions. Failure to provide such information may result in suspension or termination of your membership and forfeiture of any accrued benefits.
- Exclusive Offers
- Every 4–6 weeks, members will receive an email outlining eligible products with discounts ranging from 5% to 35% off (agency products excluded).
- Notification of offers will be sent at least 72 hours before sale events.
- Offers are valid for 24 hours on the nominated sale day and are subject to product availability at the time of ordering (while stocks last).
- Orders must:
- Be placed via your Territory Manager or email to [email protected];
- Be invoiced on the sale day (no split or held-over orders);
- Have delivery arranged within 48-72 hours of invoicing.
- No back orders will be accepted for out-of-stock items, and no substitutes or rain checks will be offered.
- Points & Rewards
- Members earn 1 point per $1 spent (excluding agency products).
- Points earned throughout the financial year will be accumulated, and rewards will be calculated cumulatively as follows:
- 2,500 points = $25 account credit
- 5,000 points = an additional $50 account credit (total $75)
- 10,000 points = an additional $100 account credit (total $175)
- 20,000 points = an additional $100 account credit (total $275)
- Rewards continue to increase in increments of $100 account credit for each additional 10,000 points earned beyond 20,000, up to a cap of 50,000 points.
- Once 50,000 points are reached, the points balance resets to zero for the following financial year.
- Points are not transferable and remain with the account holder.
- Monthly points statements will be emailed.
- Rewards corresponding to the points balance will be issued at the end of the financial year as an account credit. Ace will send confirmation of the reward to the nominated email address associated with the account.
- New members joining in August 2025 receive 1,000 bonus points.
- Opting Out
- You may opt out of the Club at any time by sending an email to [email protected].
- Points accumulated remain with the account holder and will not expire. Rewards corresponding to the points balance will be issued at the end of the financial year, even if you have opted out before that time.
- Privacy & Data Use
- By joining, you consent to Ace collecting, using, storing, and disclosing your personal information (including your name, business name, contact details, account details, transaction history, and any other information you provide) for purposes including, but not limited to:
- Administering and managing the Club;
- Communicating offers, rewards, updates, and other marketing communications;
- Improving our services, operations, and marketing activities;
- Issuing rewards; and
- Complying with legal and regulatory obligations.
- Your personal information will be collected, used, stored, and disclosed in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy https://turfcareaus.com.au/privacy_policy/, which sets out further details of how we manage your information, including other permitted uses and disclosures.
- You may opt out of marketing communications at any time via the unsubscribe link in our emails or by contacting us directly.
- Changes and Termination
- Ace may change or end the Club or these Terms at any time, with reasonable notice where practical. If the Club is ended, all earned rewards corresponding to the points balance will be issued at the end of the financial year in accordance with these Terms.
- Limitations & Disclaimers
- All offers, discounts, and rewards are at Ace’s sole discretion and may vary in frequency, value, and availability without prior notice.
- Offers are subject to product availability at the time of ordering (while stocks last). Ace does not guarantee continuous availability of any products or offers.
- Ace does not accept liability for any technical issues, interruptions, or delays that may affect your ability to participate in the Club or access offers.
- While Ace strives for accuracy, errors, omissions, or inaccuracies (including pricing, product descriptions, or offer details) may occur. Ace reserves the right to correct any such errors, cancel or amend offers, or refuse orders arising from such errors.
- Except to the extent required by law, Ace excludes all liability for any loss, damage, or inconvenience arising from participation in the Club, including from errors, omissions, or technical failures.
- Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law or other applicable legislation that cannot be lawfully limited or excluded. To the fullest extent permitted by law, Ace excludes all liability for any loss, damage, cost, or expense arising out of or in connection with your participation in the Club, except for liability that cannot be excluded by law, including liability arising from Ace’s negligence or breach of statutory obligations.
- The Turfcare Advantage Club is not open to wholesale, distribution, or reseller businesses. If a participant is found to be operating as such, Ace reserves the right to cancel their membership and void any accrued points or benefits without notice.
- Sale of Products
- All product sales are governed by the terms & conditions of your Ace account. These Club terms apply only to membership, offers, and rewards. In case of conflict, your account terms prevail for product sales.
- Governing Law
- These Terms are governed by the laws of Queensland, Australia.
- Dispute Resolution
- If a dispute arises in connection with the Club or these Terms:
- Notice of Dispute: The party raising the dispute must notify the other party in writing, outlining the issue.
- Negotiation: Within 14 days of notice, both parties will attempt in good faith to resolve the dispute through negotiation;
- Mediation: If unresolved after 14 days, either party may initiate mediation by written notice. The parties will attempt to agree on a mediator within 7 days. If they cannot agree, either party may request that the mediator be appointed by the President (or their nominee) of the Queensland Law Society or another relevant professional body. The parties will share the mediator’s costs equally.
- Legal Proceedings: If mediation fails within 30 days, either party may commence proceedings in Queensland courts.
- Urgent court relief may be sought at any time if necessary.
